DPRD TULUNGAGUNG – Ketua Komisi A DPRD Tulungagung, Gunawan, mengatakan penarikan sekretaris desa (sekdes) yang sudah diangkat sebagai PNS tidak bisa serta-merta dilakukan. Masalahnya, sampai saat ini peraturan pemerintah (PP) yang mengatur tentang sekdes belum turun.

“Kecuali sekdes berstatus PNS yang bersifat titipan karena kekosongan jabatan sekdes. Ini bisa diusulkan ditarik ke pemerintah. Tetapi, bagi sekdes yang dulu diangkat sebagai PNS, ya menunggu PP yang sekarang belum turun,” ujarnya seusai hearing Komisi A DPRD Tulungagung dengan Asosiasi Kepala Desa (AKD) Tulungagung  di Ruang Aspirasi Kantor DPRD Tulungagung, Jumat (7/2).

Menurut politisi asal Partai Gerindra tersebut Komisi A DPRD Tulungagung dalam menyikapi tuntutan AKD Tulungagung yang meminta seluruh sekdes berstatus PNS agar ditarik ke lingkup Pemkab Tulungagung tetap akan mengikuti peraturan perundangan. “Keputusan sementara kami tetap di rel mengikuti aturan yang ada,” tandasnya.

Soal hearing yang berlangsung tertutup, Gunawan menyatakan hal itu atas permintaan AKD Tulungagung.  “Kan yang menyampaikan tertutup bukan kami, tetapi dari AKD,” katanya.

Sebelumnya, Ketua AKD Tulungagung, Mohamad Soleh, mengungkapkan kedatangan sejumlah pengurus dan anggota AKD Tulungagung ke Kantor DPRD Tulungagung untuk hearing terkait permintaan agar sekdes dari unsur PNS ditarik dan ditempatkan di lingkup Pemkab Tulungagung.

“Intinya kami minta rekomendasi pada Komisi A DPRD Tulungagung agar sekdes yang dari PNS ditarik. Usulannya (yang ditarik) semua sekdes dari unsur PNS,” tuturnya.

Saat ini diakui dia, sekdes dari unsur PNS di seluruh desa di Kabupaten Tulungagung berjumlah 130-an orang. Mereka semua diminta untuk ditarik karena alasan utama tidak ber-SK (surat keputusan) kepala desa.

“SK sekdes dari unsur PNS itu merupakan SK Bupati. SK sekdes seharusnya SK dari kepala desa,” papar Mohamad Soleh.

Sementara itu, Kasubag Pemerintahan dan Aparatur Desa Bagian Administrasi Pemerintahan Setda Kabupaten Tulungagung, Yudi Irwanto, yang ikut hadir dalam hearing menyatakan akan berpedoman pada petunjuk Bupati Tulungagung terkait polemik keberadaan sekdes dari unsur PNS. “Kami juga menunggu rekomendasi dari Komisi A,” ucapnya.

Yudi Irwanto pun mengakui jika PP yang mengatur  lex specialis (hukum yang bersifat khusus mengesampingkan hukum yang bersifat umum) tentang sekdes sampai saat ini belum terbit.
